A). Resolution # 26 To establish Court Clerk to Justice Positions- TABLED FROM 1/9/2012 MEETING

 

 

Supervisor Osborn proposes the following:

 

Whereas, Pursuant to its powers under the Town Law, including Section 20(1)(a) and/or (b), to establish court clerk to town justice positions, to establish the terms and compensation for such positions, and to fill such positions subject to the consent of the particular town justice who will be served by each clerk to justice,

 IT IS HEREBY RESOLVED, as follows:

1. Effective January 1, 2012, it is hereby established or ratified, with and subject to the consent of Town Justice Nicholas Pascale, that Jennie Gent shall be appointed as court clerk to Justice Pascale under the following terms:

a. 35 hours per week;

b. Annual salary of $37,582.00; and

c. Group medical insurance benefits as provided under the prevailing group plan established from time to time by the Town of Marlborough.

2. Effective January 1, 2012, it is hereby established or ratified, with and subject to the consent of Town Justice Eleanor Gallagher, that Michelle Edwards shall be appointed as court clerk to Justice Gallagher under the following terms:

a. 35 hours per week;

b. Annual salary of $30,000.00;

c. Group medical insurance benefits as provided under the prevailing group plan established from time to time by the Town of Marlborough; and

d. The effect of this paragraph is to change the pre-existing part-time and exempt class court clerk position held by Ms. Edwards to a position entailing 35 hours per week.

3. The aforesaid court clerk to justice positions are established as exempt class titles within the meaning of the state’s Civil Service Law, and consistent with Section 20(1)(a) and/or (b) of this state’s Town Law.

B). Resolution #28 That the firms of McGoey, Hauser & Edsall Consulting Engineers, P. C. and Vandewater & VandeWater, LLP are hereby authorized to prepare preliminary studies, plans and cost estimates and SEQRA work product in connection with the proposed Project and Excess Facilities

 

Supervisor Osborn proposes the following:

 

RESOLVED, that pursuant to Section 6-c of the General Municipal Law, there is hereby appropriated from the Municipal Building Capital Reserve Fund of the Town of Marlborough, Ulster County, New York, the sum not to exceed $_______ to pay the costs of preliminary studies, plans and cost estimates for the renovation and reconstruction of the Tomvac Building located at 1520 Route 9W, Marlboro NY and the Town Hall facility located at 1650 Route 9W, Milton NY (the “Project”), as well as excess water and facilities under Town Law, section 192-a (“Excess Facilities”) to enable the Town Board to establish reliable maximum Project and Excess Facilities costs and to comply with all applicable requirements of the State Environmental Quality Review Act (“SEQRA”); and it is further

 

RESOLVED, that the firms of McGoey, Hauser & Edsall Consulting Engineers, P. C. and Vandewater & VandeWater, LLP are hereby authorized to prepare such preliminary studies, plans and cost estimates and SEQRA work product in connection with the proposed Project and Excess Facilities; and it is further

 

RESOLVED, that this action is a Type II action under the SEQRA pursuant to 6 N.Y.C.R.R. §§ 617.5(c) (21) of its implementing regulations, and is therefore not subject to environmental review pursuant to SEQRA; and it is further

 

RESOLVED that this resolution is subject to a permissive referendum as provided by Town Law Article 7.

C). Resolution #29, To accept the Wallkill Valley Rail trail and Hudson Valley Rail Trail Link Feasibility Study

 

Supervisor Osborn proposes the following:

 

Whereas, the Town of Marlborough is a founding member of the Southern Ulster Alliance, whose sole purpose is to create a structure for regional cooperation and economic development that is broadly based and inclusive; and,

 

Whereas, the Southern Ulster Alliance applied to the Hudson valley Greenway Community Council for a grant to enlist the services of a professional trail designer to design the connection between the Hudson Valley Rail Trail in the Town of Lloyd to the Wallkill Valley Rail Trail in the Town of New Paltz; and,

 

Whereas, the Southern Ulster Alliance completed and adopted a Trail Report in 2006, which outlines the future trail needs within Southern Ulster County; and,

 

Whereas, the connection of the Hudson Valley Rail Trail in the Town of Lloyd to the Wallkill Valley Rail Trial in the Town of New Paltz is an integral part of the future trails plan; and,

 

Whereas, the connection of this trail will link the “Walkway Over the Hudson” to the Towns of New Paltz, Gardiner, Rosendale and additional towns both North and South; and,

 

Whereas, the completion o f the link between these two rail trails is identified as beneficial for recreation and tourism; and,

 

Whereas, the completion of this link is consistent with each of the three goals of the Ulster County Non-motorized Transportation Plan and is a portion of “Project 4 Route 299 Bike Demonstration Corridor”; and,

 

Whereas, the Wallkill Valley Rail Trail and Hudson Valley Rail Trail Link Feasibility Study will be essential in any future grant applications to complete this trail.

 

Now, therefore be it resolved that the Town Board of the Town of Marlborough accepts and adopts the final document entitled “Wallkill Valley Rail Trail and Hudson Valley Rail Trail Link Feasibility Study”; and, moves for its adoption.
