A). Resolution # 51 To Advertise for fuel items

Supervisor Cerone proposes the following:

Resolved that the Town Board authorizes the Town Clerk to advertise for the following fuel items

Item #1 Premium diesel fuel
Item #2 Unleaded regular gasoline
Item#3 Unleaded Plus gasoline
Item#4 Unleaded premium gasoline
Item #5 Propane

Now therefore be it resolved, that the Town Board authorizes the Town Clerk to place a legal notice in the official newspaper of the Town requesting sealed bids on the aforementioned fuel items, and all bids must be accompanied by a signed non-collusion affidavit, and

Be it further resolved, that bids will be received at the office of the Town Clerk, 1650 Route 9W Milton New York 12547 until 2:00 PM on April 5, 2010 at which time they will be opened and read aloud.

B). Resolution #52 To Advertise for Highway items

Supervisor Cerone proposes the following:

Resolved the Town Board authorizes the Town Clerk to advertise for the following highway materials

Item #1 Washed sand or washed screenings for ice control
Item #2 Hot mix asphalt materials
Item #3 Material Hauling-Specs available at Town Clerks Office
Item#4 Aluminum structural plate, box culvert specs available at Town Clerk

Now therefore be it resolved that the Town Board authorize the Town Clerk to place a legal notice in the official newspaper of the Town requesting sealed bids on the aforementioned Highway items and that all bids must be accompanied by a signed non collusion affidavit, and

Be it further resolved that all bids be received by the Office of the Town Clerk 1650 Route 9W, Milton NY 12547 until 2:00 PM on April 5, 2010 at which time they will be opened and read aloud.

C). Resolution #53 To Authorize Supervisor to sign documents

Supervisor Cerone proposes the following


Whereas, the Town of Marlboro has received a special grant in the 2009-10 New York State Budget, and

Whereas, there are specific requirements and regulations governing the expenditure of these funds.

Now therefore be it resolved, that this body resolves the following

1. Administration of all funds under this grant will be in accordance with all terms and conditions contained in “guidelines to prepare grant agreements for non construction projects $50,000 and under-Fiscal year 2009-2010.” Provided by the New York State Office of Parks, Recreation and Historic Preservation


2. That Christopher Cerone, as Town Supervisor of our organization, is hereby authorized to sign legal documents on behalf of the Town of Marlborough and that such signature is acknowledgment of the acceptance by this body of compliance with all terms and conditions of the grant agreement, to be executed for the grant.

D). Resolution #54 To name portion of the newly acquired Park Land


Supervisor Cerone proposes the following:


Whereas, The water front on Dock Rd in Milton NY has traditionally been called Milton Landing, and

Whereas, the Town of Marlboro has recently purchased this water front land to be used as a town park, and


Whereas, the creation of a master plan for this park requires the naming of said park.

Be it resolved that the water front section of the newly acquired park land on Dock Rd in Milton be called Milton Landing.

F). Resolution #56 To appoint a Zoning Board Member

Supervisor Cerone proposes the following:


Whereas, a vacancy to the Town of Marlborough Zoning Board exists due to the resignation of Member Keith Festa, and

Whereas, the Zoning Board Committee has interviewed for the position of a Zoning Board Member, and

Whereas, it is the recommendation of the Zoning Board Committee, to appoint Lenny Conn.

Now therefore be it resolved, that Lenny Conn be appointed to the Town of Marlborough Zoning Board to fill the remaining term of the vacated seat effective immediately ending December 31, 2010.

G). Resolution # 57 To Perform Emergency Repairs



Supervisor Cerone proposes the following:


Whereas, after several attempts to determine the source of an ongoing water problem at Town Hall and after several meeting to discuss our options in regards to this issue, it has been determined that there exist a leak in the copper piping located in or beneath the concrete slab of the Town Hall which is causing water to flow freely below the floor, into the waste water pipes and ultimately into the septic tank, and

Whereas, the leak in the copper pipe has caused standing water in the ladies & Men’s bathrooms and has also resulted in the Town being required to pump the septic tank for a second time in as many months, and

Whereas, further neglect of this issue will result in the possibility of burning out the well pump and/or running the well dry.

Now therefore, be it resolved, that the Supervisor has deemed this to be an emergency situation and has requested via email permission from the board to authorize Affuso Plumbing & Heating to immediately address the issue by terminating the existing cold water supply line which runs in the concrete slab and to run a new cold water supply lines to all of the fixtures located in Town Hall.

Be it further resolved, that the Supervisor has received responses from the Town Board via email approving the emergency repair of the leaking water supply and that Councilman Affuso has abstained from voting on this action

Whereas, the Town Board of the Town of Marlboro wishes to make changes to the Interview and Appointment Procedure.
