A). Resolution #31 To investigate local water source (prior resolution #83 from 2009)

Supervisor Cerone proposes the following:

Whereas, the Town of Marlborough is dependent on outside water sources for public drinking water, and

Whereas, the Town conducted a possible groundwater well location, and

Whereas, the area around the present Town Reservoir was identified as a possible place to drill a well based on topographic/glacial sediment/recharge date, proximity to existing infrastructure and the face that the Town already owns the property, and

Whereas, the Engineer for the town has advised the Town that it is in the Towns best interest to pursue a possible independent groundwater source.

Be it resolved that the Town Board directs the Supervisor to enter into an agreement with J.T Eckerson to drill a test well at the Town Reservoir in an amount not to exceed $1,000.00

B). Resolution #32 To Authorize the Town of Marlborough to enter into a lease purchase agreement 

Supervisor Cerone proposes the following:

Whereas, the Highway Department of the Town of Marlboro has requested the purchase of 2 2010 International cab/chassis from Arkel Motors through State bid for $86,021.65 each, and

Whereas, there was a bid for the dump bodies, hydraulics and plow units for $33,289.00 each, and

Whereas, such purchase is authorized under section 109-B of the General Municipal Law of the State of New York, and

Whereas, Section 109-B of the General Municipal Law of the State of New York requires a resolution authorizing the installment purchase.

Now there fore be it resolved, that the Town is hereby authorized to enter into an installment purchase contract with Key Government Finance, Inc. of 1000 South McCaslin Blvd,. Superior Colorado 80027 for the purchase of 2 2010 International cab/chassis with dump bodies and plow units for the principal sum of $238,621.30.

Be it further resolved, that the said sum with interest at 4.41% per annum be paid in 36 monthly installments of $ 7,088.66 commencing on the 1st day of March, 2010, and 

Be it further resolved that for the year 2010 the Town Board has appropriated 12 payments of $7088.66 to be applied to said payments, and

Be it further resolved, that the period of probable usefulness prescribed for such equipment under Section 11 of the Local Finance Law is five years, and

Be it further resolved, that the Supervisor of the Town of Marlborough is authorized to execute the installment purchase agreement.

C). Resolution #33 To Award the contract for asbestos abatement and complete demolition of the theatre building 

Supervisor Cerone proposes the following:

Whereas, the engineers for the Town, McGoey Hauser and Edsall, consulting Engineers P.C. prepared plans and specifications of the project which were duly advertised for bid for asbestos and the complete demolition of the Theatre Building, Dock Rd, Milton, and

Whereas seven bids were received for the project and opened the afternoon of August 19, 2009, and

Whereas, the Town Board voted to reject all bids submitted for the project and to re-advertise for bids for the subject project, and

Whereas, three sealed bids were received for the re-bid of the project and opened on November 4, 2009, and

Whereas, McGoey, Hauser and Edsall Consulting Engineers, P.C., as Engineers for the Town recommended based upon review of reference data submitted, that the Town of Marlborough award a contract for the asbestos abatement and complete demolition of the theatre building 
($31,740.00) is the amount of thirty-one thousand seven hundred and forty dollars) to Stamford Wrecking company of Trumbull Connecticut pending approval of bonds, insurance and other documentation submitted to the Town, and

Whereas, the Town Board has determined that adequate funding allocations have been made from grant funding or local budget allocations to properly fund this project.

Now there fore be it resolved that, The Town of Marlborough Town Board authorizes the Supervisor to send the Notice of Award and enter into contract with Stamford Wrecking Company of Trumbull, Connecticut for the Asbestos Abatement and Demolition of the theatre building on Dock Road.

D).Resolution #34 To support Ulster County’s Submittal of an Application titled: Ulster County Decentralization of Certain Highway Services

Supervisor Cerone proposes the following:

Whereas, the County of Ulster is undertaking the necessary research and development for the submittal of an application under the 2009-2010 Local Government Efficiency (LGE) Program to be titled Ulster County Decentralization of Certain Highway Services and in amount to exceed $1,000.00, and

Whereas, the decentralization of certain highway services is based upon recommendations contained in a New York State Department of State grant funded Shared Municipal Services Study, and in particular “Identifying Opportunities for Highway Service Cooperation in Ulster County and is intended to increase Town Highway revenues while decreasing County Highway expenditures.

Now therefore be it resolved that, The Town of Marlborough, as a Co-applicant, after due consideration, has determined that it is desirable and in the public interest to support Ulster County in the submittal of an application under the 2009-2010 Local Government Efficiency Grant Program to be titled under Ulster County Decentralization of Certain Highway Services, and that as a Co-Applicant, is in support of Ulster County’s proposed decentralization proposal and as a Co-Applicant, ensures governmental coordination in the proposed program’s implementation.

E). Resolution #35 To appoint a part time police officer

Supervisor Cerone proposes the following:

Whereas, the Police Committee has interviewed the position of part time police officer, and

Whereas, the recommendation of the Police committee as well as the Chief of Police is to appoint Steven Kunak as part time police officer.

Now therefore be it resolved, that Steven Kunak be appointed as part time Police Officer effective immediately, contingent upon a back ground check.

F). Resolution #36 To appoint a part time traffic officer

Supervisor Cerone proposes the following:

Whereas, it is the recommendation of the Chief of Police to appoint Jonathon McWherter as part time traffic officer.

Be it resolved that Jonathon McWherter be appointed as part time traffic officer effective immediately.

G). Resolution #37 To appoint a deputy welfare officer


Supervisor Cerone proposes the following:

Whereas, at our annual reorganizational meeting the Town Supervisor is appointed as the Towns welfare officer, and

Whereas, Ulster County Social Services requested that due to New York State Law regarding privacy we need to appoint a deputy welfare officer who is responsible for the payment to Ulster County.

Now therefore be it resolved, that Christina Wilklow be appointed as the Deputy Welfare Officer effective immediately.
